Curigo Pharma provides private pharmacist-led healthcare services. Depending on the service, medicines may be supplied by a pharmacist under an appropriate Patient Group Direction (PGD) or prescribed by a qualified pharmacist independent prescriber following a clinical assessment.

Treatment is never guaranteed. A pharmacist or independent prescriber will determine whether treatment is safe, clinically appropriate and permitted under the relevant service.

These Terms & Conditions apply to your use of the Curigo Pharma website and services. By using our website or requesting a service, you agree to these Terms & Conditions.

1. INTRODUCTION

Welcome to the Curigo website ("Website").

These Website Terms and Conditions ("Terms") govern your access to and use of the Website, together with any products, services, online consultations, pharmacy services, clinical services, digital content and healthcare services made available through the Website.

Please read these Terms carefully before using the Website.

By accessing or using the Website, creating a Curigo account, submitting an online consultation, placing an order or otherwise using any of our services, you confirm that you have read, understood and agree to be legally bound by these Terms.

If you do not agree to these Terms, you must not access or use the Website.

These Terms should be read together with our:

  • Cookie Policy;
  • Delivery Policy;
  • Returns and Refunds Policy;
  • Complaints Policy;
  • Clinical Services Terms (including PGD and prescribing services where applicable); and

Where there is any inconsistency between these Terms and any service-specific terms, the service-specific terms shall take precedence in relation to that particular service.

2. DEFINITIONS

In these Terms, unless the context requires otherwise:

"Account" means the secure online account created by a user to access Curigo's services.

"Clinical Consultation" means any online questionnaire, assessment, review, messaging service, telephone consultation, video consultation or other clinical interaction carried out through Curigo.

"Clinical Services" means any healthcare services provided through Curigo, including pharmacy services, consultations, prescribing services and other healthcare services offered from time to time.

"Curigo", "we", "us" or "our" means the operator of this Website and the provider of the services described within these Terms.

"Healthcare Professional" means a pharmacist, independent prescriber, doctor, nurse or other appropriately qualified and regulated healthcare professional authorised to provide services through Curigo.

"Independent Prescriber" means a healthcare professional who is legally authorised to prescribe medicines independently within the scope of their professional registration.

"Medicines" means prescription medicines, Pharmacy (P) medicines, General Sales List (GSL) medicines and any other medicinal products supplied by Curigo.

"Order" means any request to purchase medicines, pharmacy products or healthcare services through Curigo.

"Patient Medication Record (PMR)" means the electronic record maintained by Curigo containing details relevant to the safe provision of pharmacy services.

"Patient", "you" or "your" means any person accessing the Website or using Curigo's services.

"PGD" means a Patient Group Direction permitting the supply and/or administration of specified medicines by authorised healthcare professionals in accordance with applicable legislation.

"Pharmacy Services" means the professional services provided by Curigo, including the dispensing or supply of medicines, clinical consultations and related pharmaceutical care.

"Responsible Pharmacist" means the pharmacist who has legal responsibility for the safe and effective operation of the registered pharmacy at any given time.

"Services" means all products, services, consultations, pharmacy services and healthcare services provided by Curigo.

"Website" means the Curigo website, mobile applications and any associated digital platforms operated by Curigo.

3. ACCEPTANCE OF THESE TERMS

By accessing or using the Website you confirm that:

  • you have read these Terms in full;
  • you understand these Terms;
  • you agree to be legally bound by them;
  • you are legally capable of entering into a binding agreement;
  • all information you provide to Curigo is accurate, complete and truthful.

Curigo reserves the right to refuse access to the Website or any of its services where these Terms are not accepted.

4. ABOUT CURIGO

Curigo is a United Kingdom private online pharmacy providing pharmacy and healthcare services through digital platforms.

Our services may include, where available:

  • private online clinical consultations;
  • pharmacy services;
  • the supply of medicines;
  • Patient Group Direction (PGD) services;
  • independent prescribing services (where available);
  • private healthcare services introduced from time to time.

The services available may change as Curigo develops its business.

Not all services are available to every patient or in every geographical location.

Nothing within these Terms guarantees that any particular service or treatment will always be available.

5. REGULATORY STATUS

Curigo is committed to operating in accordance with all applicable legislation, professional standards and regulatory requirements.

Our pharmacy services are provided in accordance with applicable pharmacy legislation, medicines legislation and relevant professional guidance.

Where healthcare services are provided by regulated healthcare professionals, those individuals remain professionally accountable for the clinical decisions they make.

Nothing in these Terms limits or excludes the professional responsibilities owed by registered healthcare professionals to their patients.

6. CHANGES TO THESE TERMS

Curigo may amend these Terms from time to time to reflect:

  • changes in legislation;
  • regulatory requirements;
  • professional guidance;
  • technological developments;
  • operational changes;
  • improvements to our services; or
  • changes to our business.

The most recent version will always be published on the Website.

Continued use of the Website after updated Terms have been published constitutes acceptance of those revised Terms.

Where changes are significant, we may provide additional notice where reasonably practicable.

7. ELIGIBILITY TO USE THE WEBSITE

The Website is intended for individuals seeking information about Curigo and those wishing to access our healthcare and pharmacy services.

By using the Website, you confirm that:

9. GEOGRAPHICAL AVAILABILITY

Curigo's services are primarily intended for individuals located within the United Kingdom.

Certain medicines, healthcare services or delivery options may not be available in all parts of the United Kingdom or may be subject to additional legal or regulatory restrictions.

Curigo reserves the right to refuse or restrict services where we are unable to provide them safely, lawfully or in accordance with applicable professional standards.

Patients are responsible for ensuring that they are legally permitted to receive medicines in the country or jurisdiction in which they are located.

Curigo accepts no responsibility for medicines that cannot lawfully be imported into another country.

10. CREATING A CURIGO ACCOUNT

Access to certain services requires the creation of a Curigo account.

When registering for an account, you agree to provide information that is:

  • accurate;
  • truthful;
  • complete; and
  • kept up to date.

You must not:

  • create an account using false information;
  • impersonate another individual;
  • create multiple accounts to circumvent clinical decisions or purchasing restrictions;
  • allow another person to use your account without our permission; or
  • create an account for unlawful purposes.

Curigo reserves the right to refuse any account registration at its sole discretion where this is necessary to protect patient safety, comply with legal obligations or safeguard the integrity of our services.

11. ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of your login credentials.

You must take reasonable steps to prevent unauthorised access to your account.

You agree to:

  • choose a secure password;
  • keep your password confidential;
  • notify Curigo immediately if you believe your account has been compromised;
  • log out of shared devices after use; and
  • ensure that your contact details remain current.

You remain responsible for all activity carried out using your account unless and until you notify us that your account security has been compromised.

Curigo is not responsible for losses arising from your failure to keep your account credentials secure.

12. ACCOUNT VERIFICATION

To protect patients and comply with legal and professional obligations, Curigo may verify your identity at any stage before or after an account has been created.

Verification may include requesting:

  • photographic identification;
  • proof of address;
  • confirmation of personal details;
  • confirmation of contact information;
  • additional supporting documentation; or
  • other information reasonably required to verify your identity.

Failure to provide satisfactory verification may result in:

  • delays to consultations;
  • delays to medicine supply;
  • cancellation of orders;
  • suspension of your account; or
  • refusal of services.

13. KEEPING YOUR INFORMATION UP TO DATE

Healthcare professionals rely upon the information contained within your Curigo account when making clinical decisions.

You agree to notify Curigo promptly if there are any changes to your:

  • medical history;
  • current medications;
  • allergies;
  • contact details;
  • address;
  • pregnancy or breastfeeding status where clinically relevant; or
  • any other information that may affect your treatment.

Curigo accepts no responsibility for adverse outcomes arising from inaccurate, incomplete or outdated information provided by you.

14. WEBSITE AVAILABILITY

Curigo aims to keep the Website available at all times.

However, we do not guarantee uninterrupted or error-free access.

Access to the Website may occasionally be suspended, restricted or interrupted for reasons including:

  • scheduled maintenance;
  • emergency maintenance;
  • software upgrades;
  • security updates;
  • technical faults;
  • telecommunications failures;
  • cyber security incidents;
  • events beyond our reasonable control; or
  • other operational requirements.

17. ZERO TOLERANCE FOR ABUSE, FRAUD AND MISUSE OF SERVICES

Curigo is committed to providing a safe, professional and respectful environment for patients, healthcare professionals and members of our workforce.

We operate a zero-tolerance approach towards abusive, threatening, fraudulent or unlawful behaviour.

Where we reasonably believe that a user has engaged in such behaviour, we reserve the right to refuse services, suspend or terminate accounts, cancel orders, decline future consultations and, where appropriate, report the matter to relevant authorities.

18. RESPECTFUL COMMUNICATION

Patients are expected to communicate with Curigo staff and healthcare professionals in a respectful and appropriate manner.

We will not tolerate behaviour including, but not limited to:

  • abusive or offensive language;
  • threatening or intimidating behaviour;
  • harassment;
  • discriminatory or hateful language;
  • repeated unreasonable or vexatious communications;
  • aggressive behaviour towards our staff;
  • attempts to pressure healthcare professionals into supplying medicines; or
  • any conduct that places the wellbeing or safety of our staff at risk.

Where such behaviour occurs, Curigo may immediately suspend communications and refuse further services.

19. FRAUDULENT ACTIVITY

Curigo takes fraud seriously.

Examples of fraudulent activity include, but are not limited to:

  • providing false personal information;
  • providing inaccurate medical information;
  • using another person's identity;
  • submitting forged documentation;
  • using stolen payment methods;
  • attempting to obtain medicines dishonestly;
  • creating multiple accounts to avoid clinical restrictions;
  • deliberately concealing relevant medical information;
  • manipulating consultation responses to obtain treatment; or
  • attempting to interfere with the operation of our systems.

Where fraud is suspected, Curigo reserves the right to investigate the matter fully.

During any investigation we may suspend accounts, delay consultations, withhold medicine supplies or cancel orders until appropriate enquiries have been completed.

20. MISUSE OF MEDICINES

Curigo has a professional duty to promote the safe and responsible use of medicines.

We will not knowingly supply medicines where we reasonably believe that they may be:

  • misused;
  • abused;
  • diverted to another individual;
  • supplied unlawfully to another person;
  • obtained for non-medical purposes; or
  • used in a manner inconsistent with accepted clinical practice.

Healthcare professionals may request additional information where concerns arise regarding the intended use of a medicine.

Where concerns cannot be satisfactorily resolved, treatment may be refused.

21. MULTIPLE CONSULTATIONS AND "DOCTOR SHOPPING"

To protect patient safety, Curigo reserves the right to investigate circumstances where we reasonably believe that a patient is attempting to obtain medicines through multiple consultations or by providing inconsistent clinical information.

This includes situations where a patient:

  • submits repeated consultations for the same condition;
  • creates multiple accounts;
  • provides conflicting medical histories;
  • attempts to obtain duplicate supplies of medicines;
  • seeks treatment after a previous clinical refusal without disclosing relevant information; or
  • attempts to obtain medicines from multiple healthcare providers inappropriately.

Where appropriate, Curigo may refuse treatment or request additional information before proceeding with any consultation.

22. CHARGEBACKS AND PAYMENT DISPUTES

If a payment is reversed, cancelled or disputed after medicines have been supplied or services have been provided, Curigo reserves the right to:

  • investigate the circumstances;
  • suspend your account;
  • recover any outstanding sums lawfully due;
  • refuse future services; and
  • pursue any other lawful remedies available.

Nothing in this section affects your statutory rights to raise legitimate payment disputes.

23. REPORTING UNLAWFUL ACTIVITY

Where Curigo reasonably believes that criminal activity, fraud, safeguarding concerns or serious misuse of medicines has occurred, we may disclose relevant information to:

  • law enforcement agencies;
  • regulatory authorities;
  • payment providers;
  • fraud prevention organisations;
  • healthcare professionals;
  • safeguarding authorities; or
  • other organisations where disclosure is permitted or required by law.

Any disclosure will be limited to information reasonably necessary for the relevant purpose.

24. INVESTIGATIONS

Curigo reserves the right to investigate any suspected breach of these Terms.

During an investigation we may:

  • request further information;
  • request additional identification;
  • suspend consultations;
  • suspend medicine supplies;
  • delay dispatch of orders;
  • temporarily suspend accounts;
  • restrict access to certain services; or
  • take any other reasonable steps necessary to protect patient safety, comply with legal obligations or maintain the integrity of our services.

Patients are expected to cooperate fully with any reasonable requests made during such investigations.

Failure to do so may result in the refusal of services or termination of the patient relationship.

25. CONSEQUENCES OF BREACHING THESE TERMS

Where these Terms are breached, Curigo may take one or more of the following actions:

  • issue a warning;
  • request additional information;
  • refuse a consultation;
  • refuse the supply of medicines;
  • cancel an order;
  • suspend access to specific services;
  • suspend your Curigo account;
  • permanently terminate your account;
  • report matters to regulatory or law enforcement authorities where appropriate; and
  • pursue any other legal remedies available.

The action taken will depend upon the nature, seriousness and circumstances of the breach.

Nothing in this section limits Curigo's right to refuse treatment where doing so is necessary to protect patient safety or comply with legal or professional obligations.

26. ONLINE CLINICAL CONSULTATIONS

Curigo provides online clinical consultations for selected healthcare services.

Consultations may be completed through online questionnaires, secure messaging, telephone consultations, video consultations or other consultation methods made available by Curigo from time to time.

The consultation method used will depend upon the healthcare service requested and the clinical judgement of the responsible healthcare professional.

The purpose of each consultation is to enable an appropriately qualified healthcare professional to assess whether treatment is safe, appropriate and clinically justified.

Completion of a consultation does not guarantee that treatment or medicines will be supplied.

27. YOUR RESPONSIBILITIES DURING CONSULTATIONS

To enable safe clinical decision-making, you agree that all information provided during consultations will be:

  • accurate;
  • truthful;
  • complete;
  • not misleading; and
  • provided to the best of your knowledge.

You must disclose all information that may reasonably be relevant to your healthcare, including:

  • medical conditions;
  • previous illnesses;
  • allergies;
  • current medicines;
  • previous adverse drug reactions;
  • pregnancy or breastfeeding status where clinically relevant;
  • relevant family medical history where requested; and
  • any other information requested during the consultation.

Failure to provide accurate or complete information may result in treatment being delayed, refused or withdrawn.

Curigo accepts no responsibility for clinical decisions based upon information that is false, inaccurate, incomplete or deliberately withheld.

28. CLINICAL ASSESSMENT

Every consultation is assessed using professional clinical judgement.

Healthcare professionals may consider a range of factors including:

  • your consultation responses;
  • relevant medical history;
  • current medication;
  • allergies;
  • clinical guidelines;
  • recognised prescribing standards;
  • national guidance;
  • professional experience; and
  • patient safety considerations.

Additional information may be requested before a clinical decision is made.

Where sufficient information is not available, treatment may be delayed or declined.

29. PATIENT GROUP DIRECTION (PGD) SERVICES

Where appropriate, Curigo may provide healthcare services under an authorised Patient Group Direction (PGD).

A PGD allows appropriately authorised healthcare professionals to supply and/or administer specified medicines to eligible patients without an individual prescription, provided all inclusion criteria are met and no exclusion criteria apply.

Patients requesting a PGD service must satisfy all clinical requirements set out within the relevant PGD.

If the applicable PGD criteria are not met, treatment cannot be supplied under that PGD.

Curigo reserves the right to recommend an alternative treatment or advise you to seek further medical assessment where appropriate.

30. INDEPENDENT PRESCRIBING SERVICES

Where available, Curigo may provide consultations with an appropriately qualified independent prescriber.

Independent prescribing services are subject to professional judgement and applicable prescribing standards.

An independent prescriber may:

  • issue a private prescription;
  • recommend an alternative treatment;
  • decline to prescribe;
  • request additional clinical information;
  • recommend further investigations;
  • refer you to another healthcare provider; or
  • advise you to seek urgent medical attention where clinically appropriate.

The existence of an online consultation does not create any obligation upon an independent prescriber to issue a prescription.

31. CLINICAL DECISION-MAKING

All clinical decisions made through Curigo are based upon the independent professional judgement of the responsible healthcare professional.

Clinical decisions are made in accordance with:

  • applicable legislation;
  • professional standards;
  • recognised clinical guidance;
  • the individual circumstances of the patient; and
  • patient safety.

Clinical judgement cannot be overridden by:

  • patient preference;
  • previous prescriptions;
  • previous treatment supplied elsewhere;
  • requests made by family members;
  • payment for a consultation; or
  • expectations that medicines will be supplied.

The responsible healthcare professional's clinical decision shall be final.

32. NO GUARANTEE OF TREATMENT

Submitting an online consultation, creating a Curigo account or paying for a consultation does not guarantee that treatment, a prescription or medicines will be supplied.

Treatment may be refused where, in the opinion of the responsible healthcare professional:

  • treatment is not clinically appropriate;
  • additional assessment is required;
  • the requested medicine is unsuitable;
  • there are concerns regarding patient safety;
  • relevant information has not been provided;
  • there is reason to doubt the accuracy of information supplied;
  • legal or regulatory restrictions apply; or
  • any other clinical reason exists that makes treatment inappropriate.

Where treatment is declined, Curigo may provide alternative advice or recommend that you seek care from another suitable healthcare provider.

33. ADDITIONAL INFORMATION AND SUPPORTING EVIDENCE

To support safe clinical decision-making, Curigo may request additional information before completing a consultation.

This may include:

  • photographs;
  • copies of prescriptions;
  • copies of clinic letters;
  • copies of investigation results;
  • proof of identity;
  • proof of address;
  • confirmation of current medication;
  • confirmation of diagnoses; or
  • any other information reasonably required for clinical assessment.

Failure to provide requested information may prevent treatment from being supplied.

34. REFERRALS TO OTHER HEALTHCARE SERVICES

Curigo's services are not appropriate for every clinical situation.

Where necessary, we may advise you to seek assessment from:

  • your GP;
  • NHS 111;
  • an urgent treatment centre;
  • an Accident and Emergency department;
  • another healthcare professional;
  • a specialist service; or
  • another appropriate healthcare provider.

You remain responsible for acting upon any advice provided.

Failure to seek recommended medical attention may place your health at risk.

35. FOLLOW-UP CARE

Certain healthcare services may require follow-up advice, monitoring or review.

Where follow-up is clinically appropriate, Curigo may:

  • contact you for additional information;
  • recommend further monitoring;
  • provide additional advice;
  • request updated clinical information;
  • recommend review by another healthcare professional; or
  • decline further treatment until appropriate follow-up has taken place.

Patients are responsible for complying with any follow-up advice provided.

36. EMERGENCY MEDICAL CONDITIONS

Curigo does not provide emergency medical services.

Our online consultations are not suitable for medical emergencies or conditions requiring immediate face-to-face assessment.

If you believe you or another person is experiencing a medical emergency, you should immediately:

  • call 999;
  • attend your nearest Accident and Emergency (A&E) department;
  • contact NHS 111 where appropriate; or
  • seek urgent medical assistance without delay.

You should not delay seeking emergency medical treatment while waiting for a response from Curigo.

37. CLINICAL RECORDS AND CONTINUITY OF CARE

Curigo maintains appropriate clinical records in connection with the healthcare services we provide.

These records support the safe, effective and continuous provision of healthcare and enable our healthcare professionals to make informed clinical decisions.

Clinical records may include:

  • consultation responses;
  • clinical assessments;
  • prescribing decisions;
  • medicines supplied;
  • Patient Medication Records (PMRs);
  • communications relating to your care;
  • clinical advice provided;
  • follow-up information; and
  • any other information reasonably necessary to support your ongoing healthcare.

Records are maintained in accordance with applicable legal, regulatory and professional requirements.

38. COMMUNICATION WITH OTHER HEALTHCARE PROVIDERS

Where clinically appropriate, or where required by law or professional obligations, Curigo may communicate relevant information to your GP or another healthcare professional involved in your care.

Examples include:

  • medicines supplied;
  • prescribing decisions;
  • clinically significant findings;
  • adverse drug reactions;
  • safeguarding concerns;
  • or other information necessary to support continuity of care.

Where appropriate, we will seek your consent before sharing information. However, there may be circumstances where information is shared without consent where this is permitted or required by law, or where it is necessary to protect you or others from serious harm.

39. PRESCRIPTIONS

Where a medicine requires a prescription, this will only be issued where an appropriately qualified prescriber is satisfied that:

  • the medicine is clinically appropriate;
  • the expected benefits outweigh any identified risks;
  • sufficient information has been obtained to make a safe prescribing decision; and
  • all applicable legal, regulatory and professional requirements have been met.

The issue of a prescription remains entirely at the discretion of the responsible prescriber.

No patient has an automatic right to receive a prescription following completion of an online consultation.

40. PRIVATE PRESCRIPTIONS

Where appropriate, Curigo may issue private prescriptions for medicines following a satisfactory clinical assessment.

Private prescriptions issued by Curigo:

  • remain the property of the issuing prescriber;
  • may only be used in accordance with applicable legislation;
  • may not be altered or reproduced;
  • may be withdrawn where a prescribing error or patient safety concern is identified before the medicine is supplied; and
  • may be subject to additional verification before dispensing.

The issue of a private prescription does not guarantee that a medicine will ultimately be dispensed if new information comes to light that affects patient safety.

41. MEDICINE SUPPLY

Where a medicine has been prescribed or supplied under a Patient Group Direction (PGD), Curigo will take reasonable steps to ensure that the medicine supplied is appropriate for the approved clinical indication.

Before supplying a medicine, our healthcare professionals may undertake additional checks, including verification of:

  • your identity;
  • your consultation responses;
  • your eligibility for treatment;
  • any relevant clinical information;
  • legal restrictions on supply; and
  • medicine availability.

If concerns arise before dispatch, Curigo reserves the right to delay or refuse supply where necessary to protect patient safety or comply with legal obligations.

42. CLINICAL SAFETY CHECKS

Additional safety checks may be carried out before medicines are supplied.
